What is equitable distribution and how does it work?

Equitable distribution is a term used to describe the approach a judge will take when dividing marital assets during divorce proceedings. Equitable distribution is not the same as equal distribution, nor does it have anything to do with alimony. As most property cannot be simply divided right down the middle, there are a number of factors the judge must take into consideration before determining how a couple's marital property and assets will be allocated. The duration of the marriage, each spouse's contribution to the marriage, their individual economic circumstances and current sources of income, whether there are children from the marriage, and if either party has an interest in retaining any particular asset will all be reviewed prior to making a final determination. If either party attempts to deplete or intentionally get rid of assets so as to prevent the other party from obtaining possession, that will also be taken into consideration - and will not be viewed kindly by the court.
